Terms and Conditions

By booking one of our services you accept the following booking conditions.

1. General booking conditions

• When you make a reservation through our agency every part of this Policy/Agreement applies to your reservation. Any change from the Policy/Agreement must be agreed to by us IN WRITING before your trip.
• You can consider a property booked ONLY after receiving our Reservation Voucher. Filling in a form (even if you provide your credit card details), calling us on the phone, or sending us an e-mail or a fax it is not enough to consider a property booked.
• When you book a property you specifically accept our Cancellation Policy and state that you have read and understood the description of the property, and that it is to your liking.
• This refers especially (but not only) to the dates (check the number of nights) and prices that have been specified by both parties. We therefore advise you to double check the conditions before reserving a property.
• The property is booked upon the payment of a reservation deposit. The balance is due in Euro, and only in Euro, on your arrival. The Reservation Voucher will specify how the balance must be paid; please DO NOT pay the balance using bank drafts or personal checks, they need at least 3 weeks to clear.
• After receiving your reservation deposit and after having checked that the property is still available, we will send you a "Reservation Voucher" e-mail; at that stage your booking is fully confirmed, and not before.
• If you book by a bank transfer you will be asked to pay an extra fee of $25.00 (regardless of the amount of your booking) because bank wire data treatment requires more work from our staff. Please note that a bank transfer needs more time than the credit card to be processed, so someone else could book the property that you have chosen with a credit card before you do.
• All advance payments must be in American dollars.
• For any chargeback suffered by any credit card issue, you will be charged $40.00 For any returned check you will be charged $30.00
We are a booking agency and as such not directly responsible for any problems you might find in the location.  However, if you notify us immediately we will do everything possible to resolve any conflicts with our participating Hotels, Bed and Breakfasts, Apartments and Villas.
• In the unlikely event that the property should be unavailable, even at the last minute, due to circumstances beyond our control, paragraph 3 (b) of this agreement will apply.

2. Check-in/check-out times

• On the day of your arrival you will be met at the property. There will be someone waiting for you when you arrive, so we need to know your flight details or your expected arrival time at the property well in advance.
• If you do not provide us your arrival time there will be NOBODY waiting for you.
• It is your responsibility to call the owner either one hour before your arrival at the property or, should you arrive by plane,  as soon as you arrive at the airport of your final destination.
• Unless otherwise stated, the earliest check-in time is 2:00 pm, sometimes 4:00 pm, the latest check-in time is 8:00 pm and the latest check-out time is 10:00 a.m. In case of late arrival, meaning after 8:00 pm, the owner has the right to ask for up to 50 Euro as a late arrival fee.

3. Cancellation policy

a) If you cancel

• Your Advance Payment will be refunded to you if BestInRome.com is able to rebook the property for the same dates, minus $30.00 in administration fees.
• You are liable for the balance due on the property, however, if you cancel at least 30 days before your check-in date you are not liable for the balance due on the property. If you cancel 16-29 days before your arrival, you are liable for 50% of the balance due on the property. If you cancel 15 days or less before your arrival, or in the case of a no-show, you are liable for the entire amount of the balance on the property.
• Clients are strongly encouraged to ensure they have suitable travel insurance arranged at the time of booking.

b) if we cancel

• In the rare case that unforeseen circumstances make the property booked by you unavailable, you will be given the choice of staying in another property of similar characteristics and price.
• If our staff is unable to provide you with another property (as specified in the previous point), your Advance Payment will be fully returned to you, and BestInRome.com will have no further liability.
• However, we would like to highlight the fact that the BestInRome.com staff commits themselves to providing you with the property you have booked, and the events described above are both rare and unlikely.

4. Security deposit

• For some properties a security deposit is required. This amount will be fully refunded upon check out, provided that there is no damage to the property. Generally, the security deposit has to be paid on your arrival in cash (in Euro) together with the balance.
• Please note that the Advance Payment is not the security deposit. The Advance Payment is needed to reserve the property, the security deposit is to pay for damages should they occur to the property. Whether you must pay a security deposit or not for the property you rent, you are nevertheless liable for any damage to the property.

5. Property conditions

• The property will be clean and ready to for your stay upon your arrival, and will be cleaned once your vacation is over. The property must be left in reasonable good order or you will be charged for cleaning above and beyond the standard cleaning fee.
• You are expected to leave the property in the same condition in which you found it. No damage is to be done to the property, the furniture, or anything inside the property. If you find something broken or not working properly in your accommodation, please report it to us immediately and we will solve the problem as soon as possible. The property is the sole responsibility of the owner. The group leader, whose name appears in the Reservation Voucher, is responsible for the behavior of her/his party.
• The keys to the property will be given to you at the time of your check-in and they are to be given back to the owner or one of her/his representatives at the time of check-out.

6. Property descriptions

• The property descriptions have been faithfully made and describe the properties accurately.
• All information (including photos) provided is correct at the time of creating the web site page and updated on a regular basis. We have the right to make changes to this information.
• Any differences found between the actual property and the description are due to occasional changes carried out by the owner, and BestInRome.com is not responsible for these changes.
• Since in Italy there are no no-smoking laws, besides restaurants, cinemas and other public places, nobody including us can guarantee a no-smoking place to rent.

7. Pets

• Unless differently stated in the property description, pets of any kind and size are not accepted.

8. Number of people

• Clients are allowed to have only the number of persons (including children, no matter their age) confirmed for the property on the Reservation Voucher.
• Should a client arrive with more in their party than specifically confirmed in the Reservation Voucher, the owner has the right to refuse entry to the property, the client has no right to any type of refund and is liable for the entire amount due on the property.

9. Thefts/damages

• BestInRome.com is not responsible for any theft, damage or injuries sustained by the clients or their guests in the property. For claims of this nature we suggest travel insurance.
• BestInRome.com is not responsible for damages caused by the clients to the properties or to the contents of the properties.

10. Car Service

• Should you use our car service, this is a service provided by a outside car service contractor. Do not contact us in case of delays or cancellations of your transportation, but rather the car service, whose name and number will be found on your Car Service Reservation Voucher.
• Remember that a driver will wait for you at the designated location (Airport, train station, etc.). If you do not  show up on time the driver will wait for no more than 60 minutes and your credit card will be charged by the car service contractor.
• If you are a no-show or do not advise the car service of a late arrival time, you are liable for the entire cost of the service.

12. Improper use of our Booking Form

• Every instance of fraud  or attempted fraud while using our web site will be referred to the competent legal authorities. We record the IP address used by the customer.
• The Booking Form is intended ONLY for making a reservation. If the apartment requested through our Booking Form is available, we will send payment details immediately. The client is then liable for the amount of the advance payment. In fact, since the client affirms in the booking form that they are committed to a reservation, we have committed to that reservation with the owner and are ourselves liable for the down payment to the owner. If the apartment requested is not available, the client is not liable for the advance payment.

13. Disputes

• The laws of the State of North Carolina (USA), without regard to its conflict of law rules, will govern these Terms. The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms and Conditions. If you take any legal action relating to your use of our site or these Terms, you agree to file such action only in the state and federal courts located in Forsyth County, North Carolina (USA). In any such action or any action we may initiate, the prevailing party will be entitled to recover all legal expenses incurred in connection with the action, including but not limited to costs, both taxable and non-taxable, and reasonable attorneys' fees.
• The liability of BestInRome.com in any dispute is limited to the amount of the Advance Payment BestInRome.com has received on the property, since we are a Rental Agency.

We reserve the right to make changes to any part of this document.
